Well the bad news is that I somehow lost my case against Mercury Telecom last week. How I don’t know however I am considering an appeal.
The good news (well not for any customers of theirs) is that they now seem to be disconnecting all their customers. From what I can gather from other sites the issue arises from their suppliers. What they don’t mention is their suppliers are Mercury Telecommunications Ltd (run by the same people) who have a series of unpaid CCJ and ceased trading at around the time the shadow company Mercury Telecom cropped up.
Hopefully the beginning of the end for Ian Burrow in the Telecoms industry. Poetic justice to say the least.

Victory achieved against lloyds TSB today. Didn’t even have to do anything to prove my case.
Judge ordered payment of the difference between my closing overdrawn balance and the charges taken plus interest on that balance (approx £192). Also awarded travel costs of £3 and Lloyds ordered to remove the default notice against my account.
Watch out Hg Telecom because you’re next!

Well its just three days now until I’m in court against lloyds TSB. Anyone wanting the full story can get it from that link but here are the highlights:
Late 2005/early 2006 saw me abandon my account with Lloyds TSB as it had got to being £312.83 overdrawn, while my overdraft limit was only £50. This was mainly due to the lovely charges that I’m sure everyone has been hearing about in the press. I did write to Lloyds TSB in December 2005 requesting a refund of charges though this was met with flat refusal.
17th October 2006 I receive a county court claim pack with Lloyds claiming the full closing overdrawn balance of £312.83. I commence what will be a very long process and request copies of my statements.
12th November 2006. Receive statements. After calculating charges and interest turns out Lloyds owed me £225. Submit defence and counterclaim to court.
31st January 2007 Hearing set for 10:00 on 15th May 2007.
Since I defended and counterclaimed oddly enough Lloyds and their Solicitors (called Sechiari Clark and Mitchell which aptly shortens to SCAM) have been very quiet (silent in fact). Should this go to trial which is looking very likely now lloyds will owe me:
- £245.02 in charges and interest (after their £312.82 is deducted)
- My costs in my time and printing costs etc. Normally costs wouldn’t be awarded in a small claim but I will be arguing that Lloyds have behaved unreasonably and as such are liable for costs
- Removal of the inaccurate default notice they have registered with my credit file and compensation for this notice
Ah well should be rich anyway after next week…. providing I win and they pay up of course.
Then I’ve got my case with my former phone company (best not mention their name as they don’t like people talking about them on public forums, lets just call them Hg Telecom). That’s going to be even more fun as they added £90 of penalty charges for a bounced direct debit of £20, disconnected my phoneline without any warning, and breached their terms and conditions. No hearing date for that one though.
